Online orders
Any orders received through the Internet after the completion of all relevant fields, the registration and sending of data according to the steps provided for by the software of this Online Store. Before you accept any orders, an Order Confirmation message appears on the screen of your computer. If you agree and press the relevant button displayed on your screen, the confirmed order is registered in the company’s system and sent via email to the address you provided.
All offers are valid until the company’s stocks are exhausted. The Order Confirmation is automatically sent and it is not possible to previously check stocks in the company’s warehouse. If a product(s) included in the Order Confirmation is not available, a representative of the company shall inform you via email regarding any unavailability and alternatives.
Prices and Terms of Payment for online orders
Products, prices, terms of shipping and terms of payment are those mentioned in the Order Confirmation. Payment is made with PayPal or credit card before the products are shipped. Follow the instructions on our online store. The invoice that will be issued is a retail receipt and will be delivered along with your order.
Delivery of online orders
Products will be delivered to the place you indicated during the placement of your online order by a private transport company. Shipping costs are determined by the transport company and depend on the weight of the products and the place of delivery as defined in the Order Confirmation. You will be automatically notified about the delivery costs during the placement of your order. Delivery time depends on the place of delivery and product availability. The company, subject to force majeure as described below, shall make all reasonable efforts to send you the products as soon as possible. Part-delivery is possible following consultation. Product ownership is transferred following full payment thereof while risk passes to the buyer at the time of the delivery.
Force Majeure
Newman.com.gr shall not be liable for any delays to the execution of the order (including delivery) due to reasons that cannot be attributed to the company or are due to force majeure. Such examples are strikes, terrorist attacks, war, delays due to suppliers, troubles in transport, troubles in production, fluctuations in exchange rates, governmental or legislative acts and natural disasters. In these cases, newman.com.gr is entitled to a time extension in order to execute and ship the orders.
Product warranty
The company does not offer any warranty regarding the quality or the suitability of products sold for any particular purpose and does not guarantee the safety and protection of users of such products. Such warranties are offered, if so, by the manufacturers and you are responsible for reading the relevant information on the product package. However, the company, without offering any warranty, and in order to facilitate its clients, assumes the responsibility to replace any defective products, provided that the product is available in the company’s warehouse, or to arrange the shipping of a new product with the manufacturer.
Although there is a complete presentation of every product, however, the colors or images of the products shown on the website may not correspond exactly to the actual ones due to the browser or the computer screen. We are not liable for any such differences. Images and colors are intended for representation purposes only. Packages may be different from those shown on the images. Weight, dimensions and capacities, where given, are approximate. For any further inquiries, users may contact the Sales Department. Furthermore, we cannot guarantee that there will be no “human” errors during updating/adding of product prices or characteristics. Clients’ Obligations

Withdrawal, Cancellations, Product Returns, Security of online transactions and Consumer Rights

Conditions of valid order

Orders can also be placed by representatives of legal persons. The company reserves its right to claim from the supervising guardian any orders that have been placed by individuals who do not have a legal capacity.

(a) fill in the relevant form with the information required to conclude the sales contract,
(b) unconditionally accept the terms of the sales contract regarding the item sold, the amount, the price, including any taxes and other costs, the way of performing the transaction, the time and place of delivery of the product by a courier company,
(c) unconditionally accept these terms of use that constitute an integral part of the contract. Users can accept all the above by clicking on the “ACCEPT” option displayed on the website.
The user chooses one of the following methods of payment: credit card, PayPal or cash on delivery. Accepted credit cards are those shown on the order placing system on the website.
Placing an order equals to the conclusion of a distance sales contract and the relevant legal framework applies (article 4 L.2251/1994, as amended and in force). The consumer is informed by the company through the website before completing the order, before filling in and submitting the relevant form about:
(a) the supplier’s identity and address
(b) the product’s essential characteristics,
(c) the price, the amount and transport costs as well as VAT, if it is not included in the price,
(d) the method of payment, delivery and execution of the order,
(e) the duration of the offer or the price,
(f) the right of withdrawal.
After sending the form, the consumer receives a copy of the order online that can be saved.
Consumer rights
Right of withdrawal. Consumers have a right of withdrawal without giving any reasons within a period of fourteen (14) calendar days, if a longer period has not been agreed, returning the product in its original state, without bearing any costs except for the return costs. The abovementioned period starts from the date of the delivery of the products. In order to exercise their right of withdrawal consumers have the obligation to send an email to sales[at]newman.com.gr, mentioning “Withdrawal” in the subject and including valid contact details so that the company Ν & Ε NEWMAN ΟΕ can contact them. In the case of exercising their right of withdrawal consumers are obliged to return the product immediately in its unopened packaging.
Right of replacement Consumers have the right to ask the replacement of the product provided that the product delivered is defective or does not correspond to the one they ordered. If the product received by the customers is defective or different from the one they ordered, they must first contact the company and return it to the company on the day of its delivery, so that it may be replaced. Products must be in their original state and consumers must have an invoice or retail receipt. We recommend that you check the products carefully upon delivery so that delivery of defective products or products that were not ordered is prevented.
You do not have a right of withdrawal in the cases of article 3l of L.2251/94 and in any other case provided for by the law or the present pursuant to the law. You do not have a right of withdrawal in the case of products including but not limited to Jordan almonds, candies, lollipops and other foods as well as products manufactured upon the consumer’s order that have special specifications, such as bags, stamps, boxes, ribbons or other products with special specifications or prints.
In any case, the maximum period for submitting a replacement request cannot be extended after the expiration of a period of fourteen (14) calendar days from the date of the delivery. It is recommended that before any return, you should contact our company. Conditions for the replacement of a defective product or a product that does not correspond to the ordered one are as follows:
(a) Contact and notify the company about the problem within 24 hours from the delivery of the product on the phone number displayed under “Contact” on the Website or at e-mail sales[at]newman.com.gr
(b) In the case of a product that does not correspond to the ordered one, it must have not been used or unpackaged and it must be in the condition in which it was received.
The company processes only those personal information required for the provision of the website and the online store’s services. This information is provided by the visitors of the website when they fill in a form online, therefore they are knowingly giving this data. The necessary processing of the website visitors’ personal information falls into the scope of article 7A par. 1 (b) L.2472/1997 and this information is not transmitted or disclosed to third parties, unless the procedure for the lift of confidentiality pursuant to the law (L.2225/1994) is followed or in the case of any obligations arising from the national implementation of Directive 24/2006. Personal information of consumers who placed an order regarding the procedure of charging a credit card is processed, under a relevant contract, by the company VIVA Online Services SA, having its registered offices in Marousi, Attiki, 2 Av. Kapodistriou, (called “VIVA”) that is 100% owned by Realize SA company, as legally represented.
Collection, keeping, processing and transmission of personal information provided by users through VIVA is made, used and processed in accordance with the provisions on the protection of private data that may apply, in particular in accordance with the provisions of L. 2472/1997 and L. 3471/2006, as in force.
VIVA PAYMENTS does not keep the users’ credit card details in its systems. All data is encrypted and then transmitted to the partner banks.
No returns are made when the ordered products were manufactured upon the consumers’ order and in accordance to their preferences and choices (ex. a product with special specifications, dimensions, prints etc.) and the products are not defective. In the case of repeated returns or if our company, at its sole discretion, deems that the consumer is abusing the right of return or acts in bad faith, has the right to refuse the return of the product even when the abovementioned terms and conditions are met.
Newman.com.gr seeks to ensure the quality control and the correct shipping of a product. However, we cannot fully guarantee that there will be no defects. For the avoidance of your and our inconvenience and any losses, it is recommended that you check carefully upon delivery of your order the condition, the correctness and the amount of the products sold in order to identify any visible defects or omissions (ex. broken products, bigger or smaller amount or product different than the one ordered etc.). If you identify any defect or error, you must contact us immediately after the delivery, on the same day or on the next working day, at 210-3228180, or at sales[at]newman.com.gr. We will ask you to return the defective product without any cost and we will see that the product is replaced as soon as possible from the date of its delivery, after it has been checked and the defect has been confirmed. In case that the replacement of the defective product is not possible due to availability reasons, our company will refund its price to the client. In case of a confirmed error that is attributable to us newman.com.gr will seek to restore the fault as soon as possible without any cost for the client. If you wish to return the products you bought on our online store, you should inform us on the phone and by sending an email to sales[at]newman.com.gr writing “Product Return Request” within the abovementioned period. Within the same period, you must return the products you ordered to the company’s address. In case of order cancellation, refund shall be completed within 30 days from the date we receive the products. Refund may be done by crediting the bank account you will indicate timely and in written. This Contract does not affect any consumer rights provided for by the law.
You can demand the cancellation of your order by calling us at 210-3228180 or by sending an email to sales[at]newman.com.gr. Depending on the status of your order, we will inform you on the available options. Cancellations are not possible in the following cases:
-When newman.com.gr has already ordered and received the ordered products from its suppliers.
-When the ordered products must be manufactured and are already in the stage of production and have been manufactured in whole or in part.
The observation of the abovementioned procedure constitutes a contractual term before any further action in front of a public authority or court and this preliminary procedure concerns users who acknowledge its binding nature by entering the website.
Difference between price in the store and online price
The prices in physical stores and the online stores may be different or the same. If purchase is made through the online store but the product is collected at a physical store, the price paid is the one displayed on the online store and not the price of the product in the physical stores.
